General Terms and Conditions
Definitions In these General Terms and Conditions, the following terms are defined as follows: • "Services": The villa management services offered by "First Class Villa Services," including but not limited to property management, rentals, maintenance, cleaning, and other related services. • "Client": The person or entity entering into an agreement with "First Class Villa Services" to obtain the services. • "Agreement": The individual written agreement between "First Class Villa Services" and the Client, outlining the specific terms of the service, such as price, duration, notice period, and other relevant details.
Applicability These general terms and conditions apply to all services offered by "First Class Villa Services" in villa management in Lanzarote, unless otherwise agreed in writing in the specific agreement between "First Class Villa Services" and the Client.
Services and Customization • "First Class Villa Services" offers customized villa management services that may vary based on the Client's needs. • The specific services, as well as prices, notice periods, and other conditions, will be outlined in a separate agreement, which becomes effective once signed by both parties.
Prices and Payments • All prices for services will be specified in the individual agreement between "First Class Villa Services" and the Client. • Payment of the agreed price must be made as specified in the agreement. • "First Class Villa Services" reserves the right to demand payment based on the agreed terms in the agreement. • Any additional costs, such as for unforeseen work or materials, will be charged separately after approval by the Client.
Termination of the Agreement • The notice period and terms for terminating the agreement will be specified in the specific agreement between "First Class Villa Services" and the Client. • If the Client wishes to terminate the agreement, they must adhere to the notice period and any other conditions agreed upon in the individual agreement.
Liability • "First Class Villa Services" will perform the services to the best of its ability and with care, but is not liable for loss, damage, or injury due to force majeure, unforeseen circumstances, or other factors beyond the control of "First Class Villa Services." • "First Class Villa Services" is not liable for damage to the villa or Client's property, unless caused by intentional or gross negligence by "First Class Villa Services." • The Client is responsible for insuring their property against damage, loss, or theft.
Confidentiality • "First Class Villa Services" agrees to treat all confidential information of the Client obtained during the execution of the services as confidential and will not disclose it to third parties without the Client's consent, unless required by law.
Intellectual Property • All intellectual property rights related to the services of "First Class Villa Services," including but not limited to documents, plans, and ideas produced during the execution of services, remain the property of "First Class Villa Services," unless otherwise agreed in the individual agreement.
Changes and Additions • These general terms and conditions may be modified, amended, or supplemented by "First Class Villa Services" at any time. Changes will take effect once they are provided in writing to the Client. • Any changes to the services or terms will only take effect after both parties sign an amended agreement.
Applicable Law and Jurisdiction • These general terms and conditions and the agreement between "First Class Villa Services" and the Client are governed by Spanish law. • In case of disputes, the parties will attempt to resolve them amicably. If this is not possible, the dispute will be submitted to the competent courts in Lanzarote, Spain.
Final Provisions • If any provision of these general terms and conditions is declared invalid or unenforceable, the remaining provisions will remain fully effective.
